A Fundamental Truth About Activism
The title of this article is nothing more than the most famous statement ever made by Margaret Mead.   Mead was a well known American anthropologist who carried out research in the Trobriands and on Manus.  She was not an activist by profession, yet she is best remembered for this statement.   It not only explains in a nutshell how change takes place in the world, but inspires thoughtful, committed citizens to stop being passive observers and start taking charge.  
Abundant examples of injustice and genocide throughout the world over the centuries should make it clear to us all that God Himself does not bring change to our world.  That is why sitting back and leaving everything in the hands of God has always been a recipe for disaster.  Instead, history teaches us that God gave us freedom to do what we wanted and and intelligent brains to control our destiny.  Sitting back and whinging achieves nothing.  Only persistent activism as practiced by Jesus Christ Himself has ever achieved landmark, game changing results in our world.    Margaret Mead is right.   

A High Level Victory Against Incompetence in the PNG Government
It was a rare example of focused PNG activism that led to the joyous surprise on 24 February.  Prime Minister Peter O’Neill announced that he was sacking the Minister of Higher Education, Research, Science and Technology (HERST) David Arore “in the nation’s best interest”.  What led to this decision?  Obviously it was pressure created by a small group of thoughtful, committed PNG citizens taking matters into their own hands.  They weren’t content to sit back and whinge in private to each other about the incompetency of the HERST minister.  Instead, they took to the social media.   Margaret Mead would be proud.  
Over several months, we read one article after another on pngblogs.com, which educated us about the Ijivitari MP corruption and incompetence and highlighted the foolishness of any government that would retain such a clown in such a high level position.  
As the truth finally came out, Minister Arore’s reputation began to collapse, including within the Prime Minister’s Department and the HERST ministry.    
Credit for putting Minister Arore’s sins on display before the world must go to the thoughtful, committed (and yes, anonymous) PNG citizens who applied effective detective work, then  combined it with excellent writing skills.  Obviously those skills came from having had an excellent level of higher education that is almost extinct in PNG.   Obviously these writers were forced into the years of writing practice that would enable them to write words that cut like sharp knives.  Hit by a thousand verbal cuts, the HERST minister was toppled from his throne and people like Keith Jackson would knowingly nod their head, knowing how powerful words can be, when they’re well organised and focused on a target.

Activists or Onlookers Amongst Our Respected Ones?
As the campaign to expose Minister Arore unfolded, prominent citizens who were in the best possible position to play activist roles and speed the process to get rid of national embarrassment included HERST’s David Kavanamur, Simon Kanehe, and  Joseph Sukwianomb.  In addition, UniTech’s Acting Vice Chancellor John Pumwa and his senior management colleagues, and probably the UniTech Council members, especially Chancellor Nagora Bogan, would have known useful information that, if made public, would speed up Minister Arore’s downfall and save the nation much embarrassment and energy.
Whether any of the above notable Papua New Guineans actually stood up for the public interest in PNG and spilt the beans on the HERST minister, we’ll probably never know.  Was one or more of them in back of the anonymous whistleblowing that divulged critical state secrets so that incompetence and corruption would finally see the light of day?  Or were they all content to passively read the words of others, so badly paralysed by a “follow the rules” mentality that they could not lend a helping hand?   Hopefully, we can put them into the first category so they can carry their heads high.  Hopefully, one of them will now take on the last remaining challenge, and that is find a way to leak the full Sevua report onto the internet.    
Prime Minister Peter O’Neill should not be overlooked.  He deserves credit for taking administrative action necessary to depose the HERST minister. However we also cannot forget that months went by with the Prime Minister doing nothing to end the nightmare at HERST.  It is painfully obvious that Mr O’Neill’s hand was finally forced by the persistence of the few committed PNG citizens who kept up the heat by spilling out distasteful truths.   In other words the true leaders in this saga were activist citizens, not the Prime Minister.

Ancient Lessons Of Activism Finally Reach PNG
How Minister Arore finally lost his job is a wonderful example of the positive power of activism.   It never would have happened if it had not been for a few committed citizens who did whatever necessary to achieve this goal.  Whether they were a few or many, or they worked together or independently, we’ll probably never know. What we can be certain about is that as a group, they never gave up.  What we can also say with certainty is that truth and justice prevailed.     
Mahatma Gandhi once outlined what you have to go through to achieve justice in our world.  Process 1 is to start speaking out and being persistent at it.  Never giving up will eventually push you through Process 1 and Process 2 will begin.   Process 2 is when your opponents start worrying about the impact of your words on their power and will stop ignoring you and start trying to silence you in some way.  If you survive this and continue to persist in your efforts, you will complete Process 2 and start Process 3.   And what is Process 3?  You win!   

A Remaining Pocket of National Shame
Tonight’s sacking of David Arore is a great victory for justice and decency in the land that we love.   However in the context of “UniTech Saga” it is only Step 1 to achieving a bigger goal:  justice for an innocent man known as Albert Schram.  
UniTech’s Vice Chancellor came to PNG to do good.  In return he was slapped with injustices that should shame all of us as citizens of PNG.  What did the Vice Chancellor of UniTech do to deserve these slaps?  His only reported crime was that he lifted the lid of a box full of dark UniTech financial secrets and shined a light inside.  His light hit the panicking faces of former UniTech Vice Chancellor Misty Baloiloi, former UniTech registrar Alan Sako, Chancellor Philip Stagg, Pro Chancellor Ralph Saulep, and former Professor Narayan Lal Gehlot, among others, who emerged from their slime holes like angry hornets and immediately began stinging the Vice Chancellor, hoping to chase him out of PNG before any more secrets would be revealed.       
It has been said that UniTech is bigger than any one person and this is very true.  However it is a worn out statement that misses the point about Albert Schram today.   Whether he appreciates it or not, the UniTech Vice Chancellor has become the most conspicuous symbol of the test of whether we as Papua New Guineans are capable of creating a just and decent society for ourselves, or whether we will forever let corruption and selfishness prevail.   Albert Schram is a powerful symbol of justice and decency.  Will that symbol be allowed to come back and shine within PNG or will that symbol continue to be pushed outside our borders, leaving us in darkness?  If justice is to prevail in PNG, Albert Schram must be given his work visa now and his return to PNG come before the end of March.      

It Is All Up To The Students Now
It will be the students of UniTech who will play the biggest role in determining whether this happens.  If they succeed in getting Schram back here to continue sharing his skills and knowledge, it will be a great national victory that will go down in the history books.   If UniTech students win, “UniTech Saga” will stop being a national embarrassment and instead serve as hope for the future of PNG.  
UniTech students, PNG awaits your action.  As a potential people power movement, you have the final word on what happens to Albert Schram.   Use your power to its fullest and apply the lesson of persistence, but also use that power non-violently and wisely.     

Unitech John Pumwa is no longer an independent voice speaking Unitechs best interests

I will report some latest going on at Unitech. As most know Prof. Pumwa has been acting VC of Unitech in the absence of Prof. Albet Schram. As such he should be following orders of the Unitech council including council decision to endorse and bring back Prof.Schram. Unitech council strongly endorsed Prof. Schrams return to Unitech so Prof.Pumwa should be promoting Prof.Schrams return at every opportunity.

Even if the PM himself tells Prof.Pumwa he does not want Prof.Schram back, Prof. Pumwas job is to remind the PM of Unitech council endorsement of Schram. He also should tell the PM the truth, that large majority of staff and students strongly support Prof.Schram and that it is in Unitech's best interest to bring him back.

It is Prof.Pumwas responsibility to do all he can and involve himself personally to straighten out whatever is blocking Prof.Shrams visa. This may be what Prof.Pumwa should be doing but he is not doing it. All new indications are that Prof. Pumwa no longer promotes Albet Schrams return.

In private since he flew to Moresby in January he has been making statement to people that shows change in heart. He now says negative things about Schram. He says that Prof.Schram was nothing special, that Prof.Schram costs the university to much money, that Prof.Schram did not do things properly, that Prof.Schram makes to many demands, and that Unitech will survive without Prof.Schram. In public he still says what Unitech council has endorsed.  That
Prof.Schram should come back. Acting bursar Bapa Bomoteng does not want Prof.Schram back either and complains about Prof.Schram costing to much. Unitech staffs and students are overwhelming insupport of Prof. Schram.   This makes the voices of Prof. Pumwa and Mr Bomoteng very unusual  People are getting suspicious why the change in  Prof.Pumwa since January.

One belief at Unitech is that Prof Pumwa has become tea boy to OHE minister or Prime Minister and no longer speaks with the independent voice as he must do to properly serve as VC of a university.  Unitech is controlled by the council not by the PNG government or the PM. Prof.Pumwa invited PM to speak at graduation and PM accepted. By doing this Prof.Pumwa violated his role to be an independent voice for Unitech especially at this delicate time. Prof.Pumwa has become the paid voice of others not the voice of Unitech. Another story going around is that Prof.Puma now treasures the VC job and was promised it informally by Unitech council. Most Unitech staffs and students would disagree that Prof. Pumwa is the man to lead Unitech to green pasture.

Now ProVC Macquin Maino is part of the game. Mr.Maino joined Prof.Pumwa trying to sack highly respected Unitech staff member Ken Polin all because Mr Polin spoke out in public in favour of Prof.Schram.   These men are Christians in name only and power hungry dictators in real life.  They are doing dishonest things right and left at the moment to make sure Prof.Schram will not come back and take over again from Prof.Pumwa. Prof.Pumwa and Maino are doing their best to silence the overwhelming voice at Unitech to bring back Prof.Scrham.  It seems no staff should speak out to support Prof.Schram.

Thank God for PNGBLOGS these stories can be told despite Prof.Pumwa and Macquin Maino. Prof.Pumwa, Mr.Maino and Mr. Bomoteng will read these words and laugh but notice they never reply to any article about Unitech. Reason being that truth is the truth and there is no argument against the truth.

ACTING SENIOR EXECUTIVE MANAGEMENT MUST RESIGN NOW AFTER THEIR SHAMEFUL BETRAYAL OF PROF.SCHRAM.  THEY ARE PAID VOICES WHO NO LONGER HAVE UNITECH INTEREST AT HEART. THEY ARE SLOWLY BECOMING DICTATORS JUST LIKE THOSE BEFORE THEM.

EVEN CHANCELLOR BOGAN SEES THAT UNITECH’S EXECUTIVE MANAGEMENT TEAM HAS FAILED

Acting VC John Pumwa and Acting PVC Macquin Maino yesterday told a large Unitech crowd that they had done all possible to bring back Albert Schram.  What they conveniently failed to mention was that even Unitech’s boss, Chancellor Sir Nagora Bogan, does not share their optimism.  Instead:
“I share your sentiments about the lackadaisical and protracted delay by SEM of Unitech in the implementation of the Council Decision of 12/2/2014”  (letter to Mr Justin Kehatsin of National 
Academic Staff Association about the SEM’s progress on the Shram matter).
The words “lackadaisical” and “protracted delay” are strong words that slap hard.  Sir Nagora is a man of respected judgement and would not use those words lightly.  Sir Nagora’s observations describe the same issue that students and staff have become irritated about: the lack of visible action by the Unitech senior executive management (SEM). 
Yesterday Pumwa and Maino tried to convince us that our perceptions of their bad performance was  misplaced.   In view of Chancellor Bogan’s words this was purposeful deception.  They have now destroyed their last remaining credibility, showing they cannot be trusted to tell the truth.  
At the forum, Pumwa and Maino urged us to appreciate all they have done at Unitech over the past year and forget about the issue at hand. 

In other words, Pumwa and Maino want us to be grateful that they didn’t screw up all of Unitech over the past year but only screwed up the most important issue on the minds of nearly everyone at Unitech.  What low standards they invite us to follow as we try to show the world that we are capable of managing our own affairs.  The worst strategy is to place unqualified colleagues into important management positions, watch them fail, then follow Pumwa and Maino’s advice and pretend it didn’t happen.   Meanwhile he rest of the world keeps their eyes open and witnesses not only our failures but our inability to honestly admit them.       
Over the past weeks Unitech’s reputation has been badly damaged by rumours that try to explain why Unitech’s efforts to resolve the Schram saga was moving so slowly.  The blame for this windstorm rests squarely on Pumwa and his SEM.  They have shown no abilities whatsoever to detect the growing anger of students and staff and take action to relieve the pressure.   Only when the anger finally boiled over and began spreading as comments on Facebook, articles on social media like this one, letters to the newspapers, opinion papers posted and scattered all over campus, finally resulting in yesterday’s forum, did Pumwa and Maino give their side of the story.  
Pumwa’s philosophy on dealing with dissatisfaction at Unitech is to wait in his office and invite  students to come see him when they’re unhappy.  That’s in fact what he asked students to do yesterday. This confirms that Pumwa still thinks he lives overseas in a land where people speak out easily.  In the PNG context he shows no ability to detect and handle upcoming problems before they get out of control.  With regard to staff feedback Pumwa seems not to realise that he has a reputation for harsh, impulsive reactions and also being a hard head and not changing those impulsive opinions.   Why share opposing views with him when he won’t change his mind anyway and you might suffer the punishment Pumwa is putting on Ken Polin?     
The reason why there is a unified protest moment on Unitech that could close the university down is because the SEM failed miserably in dealing with the Schram affair.  Pumwa and his SEM’s complete failure to make their actions transparent to the public at large explains why pngblogs has become the default Unitech daily newspaper while the Unitech reporter publication is dismissed as a propaganda mouthpiece.   In the area of communication, Pumwa and his team are as bad or worse as the former VC Misty Baloiloi and Registrar Alan Sako, a sad two people to be linked with in terms of performance.
There is something else that Chancellor Bogan wrote about on 20 Feb which relates to SEM’s recent reprehensible demand for Ken Polin to resign or be terminated for speaking his views on the Schram affair:    “As Chancellor I would like to see that the affairs of Unitech are managed in an open, transparent, mature and highly professional manner.  This includes allowing staff and students to offer constructive critique of how we manage the affairs of Unitech so long as it is done respectfully, rationally and is confined to substantive issues.”  Ken Polin’s speeches have always been respectful, rational and substantive.  In general Pumwa and Mainos’ childish, impulsive and deeply bureaucratic reactions to silence whoever speaks out against their leadership reflect what the previous regime of Baloiloi and Sako were expert in.  Telling people to spy and find out who speaks out against your work and policies only fans the flames. 
 Pumwa and Maino have fooled themselves into thinking there are only a few disgruntled staff or students, therefore only a few heads to identify and cut off.  Yesterday’s crowd hopefully makes them realise that most of the university has turned against them.
Pumwa and his SEM have given sufficient evidence that they lack crisis management abilities.  No one questions Pumwa and Maino’s professionalism at signing passout slips, chair meetings efficiently, push papers in the right directions after writing approved or not approved, give inspiring speeches and at their heart be good people who care about Unitech.    
However, anyone serving in their positions of high responsibility cannot be content to be a bureaucrat.  They must also think ahead, plan strategically, communicate even when they might not think it is necessary, and go out and mix with staff and students to get a better idea of how they see the world.  In times of instability as Unitech has been in for awhile, high administrators cannot fail to transparently communicate.  They cannot react like tyrants when told that people are speaking against them.    Intellectuals at Unitech have seen for a long time what our Chancellor Sir Nagora now expresses his concern about.     
Yesterday, Pumwa and Maino finally spoke out and interacted for a long time with concerned students and staff.   Once again, this did not reflect leadership on their part.  It was another reaction caused by staff and student pressure.   Activist staff and students get all the credit for showing leadership.

HERST Minister Gore, Solving Unitech Saga Is Simple

Hon Minister, you have assumed the Ministry of perhaps the most important department for our nation's future in a time of crisis. Congratulations on your appointment!

In your acceptance speech you said that you would make solving Unitech  Saga your top priority.  What is worrisome is that you also said that  it is too early to give details of your plans on how to solve the crisis.

Minister Gore, time is running out.   The deadline set by the Unitech  Council for Albert Schram to come back is only weeks away.   You too  will be accused of using delaying tactics unless you have a plan ready  to go within the next few days. Hopefully, being appointed Minister of HERST means that you take a  keen interest in PNG higher education and have been following Unitech Saga to some extent.

If not, here is a brief refresher course. Unitech Saga is a battle between good and evil. The Saga started when newly recruited Albert Schram naively thought the Unitech council supported good governance and noted the importance of resolving years of financial irregularities.

Evil raised its ugly head, in the form of all those who had been  mismanaging Unitech or misusing its funds.   A war started to remove  Albert Schram and get him out of the country so that the evil deeds at Unitech could be effectively covered up again and forgotten.

Evil received a setback when the Sevua report has cleared Albert Shram of all alleged wrongdoing made up by the now disgraced former Council members.

The current Unitech council has endorsed Albert Schram's return.  Unitech's staff and students seem to support Schram coming back in the majority.

In other words, everyone who is good and decent and cares about this country is pretty much on Albert Schram's side.The only obstacle is that Foreign Affairs will not give Albert Schram a new work visa. Minister Gore, the solution to Unitech Saga is simple. Remove the government obstacles that are keeping Albert Schram from coming back to PNG.

Maybe there is a rogue element within PNG Foreign Affairs that has caused this problem to continue endlessly.  Maybe it was your predecessor, David Arore who was pressuring Foreign Affairs not to grant the work visa.

Hopefully, the cause for the work visa blockage is not the Prime  Minister, although we all learnt that he is not above petty politics  with expatriates.   The evidence is in the deportation of Mark Davies of the PNG Sustainable Development Programme.

Despite that complication, your work can be relatively easy. Give  the facts of Unitech Saga to Foreign Affairs Minister Rimbink Pato or to your big boss.  Make note of the fact that deporting expatriates  using dubious reasons tarnishes our international reputation and makes  us look like a banana republic.

In short, do what is necessary to remove the block at Foreign Affairs so that Albert Schram an come back to Unitech to serve out his contract, with all time lost during his deportation being added back onto his contract as compensation.

Bring him back so that we can see for ourselves how Albert Schram performs in cleaning up the mess that is Unitech.

The True Story Behind William Duma Sacking

It is evident that last week’s turn of events by Oil Search have arguably put PNG government a long way out of the chess game and resulting in the removal of William Duma as PNG long term Petroleum and Energy Minister.

* The new arrangement entered by PNG government to directly purchase 10% equity in Oil Search Limited was due to the fact that IPIC could not re-sell the exchangeable bonds that was borrowed in 2008 to finance PNG LNG project equity and that it expires in Mar 16 2014.

* Since IPIC is a long term investor, it was apparent that a take-over from Oil Search by the Arabs was eminent. Hence, the only way to prevent a take-over was to keep the PNG government in play by offering them 10% equity into Oil Search.
Oil Search MD Peter Botten foresee an acquisition of Pac’s 23% stake in the Elk/Antelope gas field will provide the opportunity for PNG government to buy into the company and also give Oil Search the pre-emptive rights to decide on the future of the development of the Elk/Antelope gas fields.

* The material acquisition by Oil Search have put at odds all ambitions flagged by French giant TOTAL and Interoil plans for stand-alone LNG plant in the gulf province. This acquisition by Oil Search also means that TOTAL's deal with Interoil is in limbo because part of the condition stipulated in the contract was for Interoil to acquire Pac’s interest and have them out of the project before they can proceed.

* It is now evident that TOTAL may cut back its 61% stake and sell to another third party, of which Oil Search may exercise its pre-emptive rights and offer it to ExxonMobil for a potential opportunity to enter the Elk/Antelope joint venture. From a layman’s view, it is likely that Exxon was behind all the recent moves so that once it enters as a joint venture, it can take the opportunity to expand the existing PNG LNG plant and provide a quicker development with Oil Search on the Elk/Antelope Gas Resources.

* On the local front, it i most likely that William Duma was considered an obstacle to the arrangement and therefore removed about the same time before the announcement of the purchase. Although it is a win-win situation for Oil Search, Exxon and the PNG government, not enough considerations being offered by the PNG government and Prime Minister to negotiate in the deal. It is likely that the PNG government was only used as a pawn to facilitate the deal. Once again, deals are being bulldozed by corporations and Prime Minister bowing down unknowingly - "yes"no"yes"no".

* Papua New Guinea should start take the lead in all negotiations as this is our land and our resources, we don’t want to play second feeder and only to become spectators in the future. The establishment of Kumul Petroleum must be legislated now, why is the government taking too long and missing out on such big opportunities? Please put your members to task or it will forever be too late!

Unitech Management Tries Racism To Get Support For Their Survival

Leading up to the campus wide student boycott that has shut down Unitech, a recent memo indicates not only a secret underlying strategy to keep their positions and force out VC Albert Schram, but also a desperate ploy to rally staff to their support at a time when most have given up on their leadership.

Pro VC Macquin Maino sent the memo out to all Unitech staff, part of which tries to rally racists on campus to come to the SEM’s defence to keep the SEM ship from further sinking beneath building waves.  Here is some of what he wrote:

As a Papua New Guinean, I refuse to accept speech or written connotations that we are incapable natives forever reserved as ‘cargo-carriers’, unable to wiggle our way out of ignorance, and so are forever doomed. Forgive me but as one intellect national, I refuse to accept this because it is an insult to learned Papua New Guineans!"
The Pro VC went on to give the impression that anyone who supports exiled VC Albert Schram against Acting VC John Puma is guilty of thinking that nationals are not capable and only expats can do the job.

The staff and students rising up at Unitech against the SEM and protesting for VC Albert Schram are 99% national. Their anger at the Acting SEM has nothing to do with expat versus national, but concerns the personal incompetence of John Pumwa and Macquin Maino in dealing effectively with the situation and keep all informed of exactly what they were doing to bring Unitech Saga to a successful close with Albert Schram back at the helm to do the job he was hired for.

Only desperate people resort to racism to get support.  It is becoming more obvious hearing every new word coming out of the mouths of John Pumwa and Macquin Maino that they never actually supported Albert Shram coming back, that they were overconfident they could do the job as well as Schram, and when it became obvious to all of Unitech that they had failed, they have started to use the racist argument that if Schram comes back it shows a mindset that nationals cannot do the job.

In sending out this inflammatory memo, Macquin Maino has made it clear to all expatriates on campus that their services are not needed and that there are nationals ready to take the jobs of each and every one of them.  

Since all the angry words at the forum where they spoke doesn't seem to have penetrated the ears of the SEM on what the real issues are, maybe this will make it loud clear.

The issue is justice for Albert Schram who has been treated like a pig by our nation.
The issue is that Albert Schram showed all of us that he was capable of doing a good job as VC.
The issue is why didn't the SEM do more to get him back.
The issue is why if the SEM wanted him back are they now making all kinds of statements behind the scenes that they don't want him back?
The issue is that John Pumwa has failed at his job as Acting VC to provide good leadership to resolve Unitech Saga.

THE SENGI REPORT ON PIP FUNDS CORRUPTION AT UNITECH

A recent article on PNGBlogs made false and malicious allegations against Unitech lawyer Mr Simon Sengi.   His high moral character and commitment for fairness was unfairly challenged in the articles and in the vicious attacks made by anonymous commenters. These negative words cannot go unanswered.  Unitech is very fortunate to have the full time services of Mr Sengi. To reply to the various empty comments of his detractors:

1.  Mr Sengi is well aware of the PNG constitution and its protection of free speech but this does not include any free speech that angers or agitates staff or students.
2.  Mr Sengi's ongoing actions against Unitech staff member Mr Ken Polin are to keep peace and order at the university.
3.  The vehicle purchased for Mr Sengi is to allow him to carry out his official duties as he had no vehicle before the purchase.
4.  Whether or not Mr Sengi takes alcohol is his private business.

Anyone who doubts the commitment of Mr Sengi to Unitech would do well to download and read the attached "REPORT  OF THE PUBLIC INVESTMENT PROGRAMME (PIP) FUNDS BUDGET 2011 EXPENDITURE INVESTIGATIONS COMMITTEE".
Known as the Sengi Report, this is the document that broke open the doors on the corruption at Unitech.  The Sengi Report was the basis of much of what was included in the later Sevua Report.  The Sengi Report lays out the most accurate picture ever produced of mismanagement at Unitech.  The investigation succeeded only through the hard work of Mr Sengi and his fellow committee members, which included Acting Vice Chancellor John Pumwa.
As you can read with your own eyeballs, Sengi Report gives extensive information into the corrupt use of governmental PIP funds at Unitech for 2011.   The investigation focused on the whereabouts of a small part of the K26 million in PIP funding being held by the university in 2011.

Few Highlights of the Sengi Report:

1. For the following five (5) projects there was no  evidence found of any substantive proposal which would have  defined the  scope  of following   projects.  Those projects were not vetted by competent committee and there was no evidence of a tendering process nor were any acquittals produced:

    A.      NATSL Rehabilitation (K1,800,000):  This is the National Analysis Testing Services Lab.  The  then  Vice  Chancellor approved it, by- passing due process which would have  otherwise required one.

    B.      Project carried   out by Frank Ogisi through Valuation Consultancy:  The  then  Vice  Chancellor approved it, by-passing due process which would have  otherwise required one. With  Mr  Ogisi's case the previous Vice Chancellor  was told  that Mr Ogisi's company account was closed, but  he insisted that the payment be made  to Mr Ogisi  in his name, so that was done.

    C.      Project carried out by Unitech Planner Mr Kakini's company - Extreme Good Solutions:. The then Vice  Chancellor approved it, by-passing due  process which would have  otherwise required one.

    D.     Purchase of equipment by  Professor Narayan  Gehlot: (K675,000) The  then  Vice Chancellor approved it, by-passing due  process which would have  otherwise required one. There  was no evidence of prior approval on the purchase. The equipment  were bought because the then Vice Chancellor gave verbal approval and no evidence of written  approval exists.

    E.      Dhanhus Info  Tech  Project and Datec  Wireless Network; The Chancellor approved it,  by-passing due  process which would have otherwise required one. The Chancellor approved this  project. Total K760,000.

2.   Professor Narayan Gehlot, Bursar Jimmy Inbok, and Project Office Manager Brian Kakini did  breach Standard Terms and  Conditions of Employment  and  were  criminally negligent in  the discharge of their duties.

3.   In the  cases  of Professor Narayan Ghelot and  Mr. Brian Kakini, there is  evidence that they knowingly and  intentionally, in collusion and collaboration with others, orchestrated moves to  avoid and  by-pass proper and due      processes for personal advantage and gain.

4.   That  PIP funds have   been   diverted to  projects outside of the  PIP funding guidelines and  without following proper and  legal processes and  often by  people without authority to  do  so, in the  absence of and contrary to      relevant expert and technical advice.

5.   That expenditure of PIP funds for purposes other than  that for which such   funds  were initially  submitted for and secured amounts to misappropriation.

6.   The Chancellor Philip Stagg was responsible for the  award of the  Dhanush Info Tech contract. His involvement in leading a delegation to India  to negotiate  and   award  the relevant contract is considered  not proper by the       Committee.

7. 
  The  Committee had  information to  show that the Vice Chancellor Misty Baloiloi was involved in  the improper awarding of contracts amounting to abuse   of  proper  processes. Evidence exist from contracts to Extreme Geo-Solution        Ltd, Frank Ogisi, NATSL and the Professor Ghelot  case.   In  all  these   instances,  the   then Vice  Chancellor ignored proper and  due  processes and was in gross  violation of these  processes in making those  awards.

8.   The Committee also received information on substantial abuse  of established processes in  the  award of other major contracts amounting to  substantial amounts of money.  There  is reason to believe that there was deliberate gross       abuse  of proper and legal procedures of tendering, screening and awarding of contracts.

9.   Furthermore K765,600.00 as paid  to  an  Architectural Consulting firm for the design of two (2) 100 bed dormitories, but they did not comply, so were  fired yet payments were still made. None of these revelations would be known        today if it were not for the Sengi Report. Acting VC John Pumwa was a principal member of the investigation and his role in fighting for Unitech must be recognized.

We the people of Ora Province, particularly from the Sohe Electorate who have supported and voted for Governor Gary Juffa have completely lost faith, respect and trust in his leadership, which has been marred by deception and contradictions. The custodial and leadership hopes we had of Governor Juffa has materialized into a leadership nightmare following stunning revelations of his conduct in Office as a leader over the last 17 months.

His actions and conduct while in Office in ·the last 17 months have grossly breached 6 main provisions of the Leadership Code provided under Section 27 of the Constitution of Papua New Guinea and we would like to register this formal complain with your good office the Ombudsman Commission of Papua New Guinea to investigate and recommend appropriate measures within your powers as this is unbecoming of a leader.

ORGANIC LAW ON THE DUTIES AND RESPONSIBILITIES OF LEADERSHIP A. "LEADERS MUST NOT USE THEIR OFFICIAL POSITION TO BENEFIT THEMSELVES PERSONALLY OR THEIR FAMILIES. FRIENDS OR ASSOCIATES"

Al. Whilst Governor Juffa was the Commissioner of Customs prior to his resignation to contest the 2012 General Election had craftily signed the Terms of Reference for the Memorandum of Understanding (MoU) to be executed between PNG Customs Services, LNG PNG and PNG Projects Services Limited (a company owned bv Governor Gary luffa's· wife Ms Amanda ManelickSprang and two other director. one from the United States of America and the other from Singapore). This MoU has allowed PNG Project Services Ltd to illegally take over the Post Clearance Audit (PCA) function from the PNG Customs Office specifically for the .Jucrative PNG LNG cargos.

A2. Under the PNG Customs Laws and Regulations, PCA ensures due diligence in compliance and assists firms with large imports selfassess to attain accuracy and efficiency with lodgments in the long term. Together with similar mandatory functions, no entity under any MoU or MoA- not provided under the PNG Customs Act and Regulation can replace PNG Customs Services as these functions are retained by the Independent State of PNG as its revenue generating activity.

A3.    PNG Customs Services has ILLEGALLY paid millions of kina to PNG Project Services Ltd, the monies it has collected as Government Revenue WITHOUT lawful appropriation from the National Parliament Budgetary process. Until just a few years back, PNG Customs Services was performing this function quite prudently generating income for the State as well as assisting large firms develop accuracy in self-assessments of imports. This highly questionable arrangement by Governor Juffa replacing PNG Customs Services for the multi-billion dollar PNG LNG cargos and all related contractors cargos had diverted State Revenues derived from PCA, to Governor Juffa's wife and her associates through PNG Project Services Ltd.

A4.  Although Governor Juffa is not a Director or Shareholder in PNG Projects Services Ltd he is cited in two instances as having significant and or direct interests in PNG Project Services Ltd. Firstly, knowing well it was against the Duties and Responsibilities of a Leader and a breach of the Leadership Code, he negligently facilitated his wife to obtain the PCA Contract while he was in the position of influence. Governor Juffa benefits from the said Customs Contract by living with his wife in a downtown Port Moresby apartment managed by DAC Real Estate costing over K70,000.00 per month paid by PNG Projects Services Ltd.

AS Governor Juffa's despicable travel bills have all been taken care of by PNG Projects Services Ltd, given that there are no records of Oro Provincial Government paying for these trips. We are also aware that Governor Juffa had not declared any other forms of income or interest in any other businesses to the Ombudsman Commission of PNG, which could support these lavish lifestyles.

A6    We also seek the Ombudsman Commission to investigate the PNG Project Services Ltd Account held with the ANZ Bank of PNG in Port Mores by as. we are reliably informed, there are several standing orders instructing the bank which has transferred substantial amount of monies (State Revenue) to the United States of America and other destinations including Samoa. The beneficiary of the funds transferred to Samoa is the other wife of Governor juffa who was also looking after his two children from his first marriage.

The transaction report with the ANZ Bank in Port Moresby shows his Samoan wife's details. Essentially, his Samoan wife and his other Children from his previous marriage benefit from the proceeds of the said MoU between PNG Customs Services, PNG Projects Services Ltd, and the PNG LNG Project. Spouses and children benefiting from such devious scheme, is totally inexcusable as a major breach of the Leadership Code.

"WE BELIEVE SIPHONING OF FUNDS AS SUCH IS A CRIME AND SO UNDER THE PROCEEDS OF CRIMES CRIME ACT THEY SHOULD BE RECOLLECTEDAND RETURNED TO THE STATE. IF SIR FREDRIC CAN, RETURN THE MONEY FOR THE PURPORTED PUBLIC SERVICE HOUSING SCHEME, WHY CAN'T THE SAME APPLY TO PNG PROJECT SERVICES LTD?"


THE INTEGRITY OF THE GOVERNMENT OF PAPUA NEW GUINEA MUST. BE PRESERVED AT ALL TIMES. NO ACT OF A LEADER SHOULD ENDANGER OR DIMINISH RESPECT FOR AND CONFIDENCE IN THE INTEGRITY OF GOVERNMENT
We also seek the Ombudsman Commission's interpretation of Governor Juffa's high propensity to travel overseas, far more than the Prime Minister, Foreign Minister and other Government Officials. He has demonstrated blatant disrespect on the directives issued by the Prime Minister banning all travel unless the Ombudsman or the Prime Minister had sanctioned the reasons. THIS CERTAILY APPEARS TO BE A BREACH OF THE LEADERSHIP CODE AND MISCONDUCT'IN OFFICE,

This shocking trend has, never been seen before in any leader of Papua New Guinea, prior to and after independence, which we believe is a matter of interest for the PNG Ombudsman Commission. Attached is a schedule of Governor Juffa'a travel in the last 17 months with questions and issues raised to the, the Ombudsman Commissioner:

B1     In July 2012 after his declaration as Governor for Oro Province, Governor Juffa started travelling overseas for almost every remaining months of the year 2012 until December. The schedule shows instances where the Governor would travel twice in a month.

B2     In 2013 the Governor also travelled the entire months from January to December. As he did in 2012 he would travel twice a month.

B3     It is shocking that in just over 1 year Governor Juffa was absent from Oro Province and PNG for almost 200 days. Was the PNG Ombudsman Commission duly informed by the Governor for all his, overseas trip and did the Commission clear his travel whether business or private?

B4    We are reliably informed that all these trips are paid first class, and therefore taking into account the living expenses, travel insurance and ·incidentals we estimate that total costs exceeded K500,000.00. It is further confirmed that these costs are not, incurred by the Oro Provincial Government or other businesses as declared in the Annual Income Statement to the Ombudsman Commission by the Governor. Is the Ombudsman Commission duly informed how and who pays for all these costs?

B5     For all these 200 plus days Governor Juffa travelled and stayed overseas, did he inform the Commission why he was travelling and where was he going?

B6     Is it proper for a leader especially Governor )uffa to be in the Province for 48 DAYS ONLY OUT OF 464 days where he spent 240 DAYS IN PORT MORESBY AND OVER 200 DAYS OVERSEAS? In 464 (17 months) can the Ombudsman Commission of PNG fathom that Governor Juffa spent only 48 days in Oro Province?

B7    Is it a prosecutable offence under the LEADERSHIP CODE that Governor Juffa illegally awarded a Customs Contract to his wife and associates under PNG Project Services Ltd while he was Commissioner of Customs covered under the Leadership Code? Is it also a prosecutable office that Governor Juffa spends almost 200 days overseas benefiting from all that illegal proceeds while spending only 48 days in the last 17 months after elections in the Oro Province?

B8     Is it a criminal offence that INCOME OF THE STATE without lawful appropriation has been siphoned through this MoU that is not provided under the Customs Laws and Regulations of the Independent State of PNG? If the siphoning of State Revenue is a prosecutable offence, can theProceeds of Crime Act be applicable in this instance  to recover State Revenue ILLEGALLY PAID so far to PNG Projects Services Ltd?

C. "LEADERS MUST NEVER ALLOW THEIR INTEGRITY TO BE CALLED INTO QUESTION"

Cl     We further request the Ombudsman Commission to investigate Governor Juffa's employment of his cousin brother a Mr Philip Embahe as his Executive Officer. First and foremost Mr Embahe is a grade 10 or thereabouts drop out and has never went on to year 11 and 12 in a National High School or even matriculated in a recognized institution. He has no tertiary or university level education and equally no work experience in Government or Public Service environment.

C2     Mr Embahe was employed by Governor Juffa directly from the prison in Bomana, in the National Capital District where he was remanded in custody for shooting at two detectives of the Royal PNG Constabulary. The Policeman were  pursuing an armed robbery when Mr Embahe who was involved in the robbery shot at the Police Officers causing panic where a Policeman was shot in friendly fire. He was captured and locked up in prison but through Governor Juffa's intervention he was released later without any conviction of his crimes and was immediately employed. The aftermath of the case is not known. While employed as Governor Juffa·s Executive Officer Mr Embahe was seen and caught by Popondetta residence and Police for discharging firearms at senior Oro Provincial Administration Officers and the public. In Port Moresby MrEmbahe is known also for discharging the handgun regularly at Governor Juffa's old residence at Henao Drive 5 Mile, where he now illegally resides. All firearms related incidences of Mr Embahe, can be confirmed by, the neighbors at 5 Mile opposite Murray International School and the Boroko and Gordons Police stations where they are reported.

C3     There has also been a major sex scandal in the Office of the Governor in Popondetta involving Mr Embahe and a female staff of Governor's Office and Governor Juffa has been notified and advised to reprimand and discipline Mr     Embahe and the female staff but be 'has not acted on the issue so far. Mr Embahe has also misapplied Oro Provincial Government funds of which the latest spate has been the purchase of vehicles for his girlfriend, which she has apparently damaged one of the cars. These records can beverified with Freeway Motors Ltd where, vehicles are purchased. All this inappropriate behavior and conduct which demean the Office of the Governor and the leaders integrity has been taken up with Governor Juffa by his staff and community leaders on numerous occasions but the Governor has dismissed them as frivolous. Demeaning and causing to bring into question the leaders integrity should not be considered frivolous, it is a breach of the Leadership Code. Governor Juffa and his cousin brother, Mr Embahe have, brought into serious question his integrity and credibility and that of the Government of Papua New Guinea. Any hope to salvage some
honor or integrity of Governor Juffa if any at least has been completely annihilated by Mr Embahe.

C4      Given Mr Embahe's limited educational qualifications he does not qualify, to attra.ct Grade 14 Salary under the current SRC Determination. However, over and above that Governor Juffa has allowed him to be paid at Level 3(Grade 20) salary, which is well above Ministerial First Secretary salary level and is equivalent to a Government Departments Deputy Secretary. We believe that this amounts serous misconduct in Office and breaches of the Duties and Responsibilities of Leaders under the Leadership Code by the Governor.

D GENERAL CONDUCT

The Governor's unprecedented absence from the Province has seen his complete disconnection with the people and the Province. Amongst the notable absence, we noted that in 2012 during the visit of the Head of the Anglican Church in the world, the Bishop of Canterbury, Governor Juffa deliberately went on a vacation up to the highlands provinces with some tourist friends of his. We knew that because he was, notified by the Provincial Government and the Anglican Church as one of the guest speakers. As almost 100 percent of us from the Province are Anglicans and education, health and, all other basic services up to this day in the Province are still delivered by the Church, this was an opportune time for Governor Juffa to acknowledge Oro Province's indebtedness to the Church and its contributionsin the spiritual, human, social and economic life in the Ora Province. In his wisdom and judgment this event was insignificant and did not warrant his presence and acknowledgement


Another notable absence was quite recently during the opening of the Oro Provincial Justice Department facilities in which the Chief Justice, other Senior Judges, Chief Secretary and other senior government  Officials came tu the Province. The Governor was listed as a keynote speaker as it was a major law and justice sector facility for the region in the Province. The Governor displayed sheer arrogance of the highest order by unceremoniously and with total disregard and disrespect for institutional establishments and authorities of the Independent State of PNG jetted off that same morning to the United Unites of America, where he has spent over 200 days in the last 17 months.

Even in the new year, (2014), on the 9th January an emerging local airline company, Travel Air opened its new destination in Oro Province and the Governor was invited for the occasion. Governor Juffa was still overseas in the United States of America and could not attend the inaugural event, which opened up an additional air travel service in the Province. Governor's thoughts of such occasion are very hard to define but we in the Province see it as a milestone event given that, 3 different airlines of the same carrying capacity are now serving the peopl.e of Oro Province. Governor Juffa's disconnection with the people and their dreams, visions and aspirations of development and change can be been seen in his anti-development philosophies. He deports foreigners with minimum of offences from the Province, threatens and intimidates business houses, stops agro-forestry projects, stops logging and sawmilling projects and demands unthinkable equities free of charge from businesses.

These commercial prac.tices are unconventional and not seen anywhere in the world. The small people who try to make ends meet in the fringes of the town in little markets are dealt by Police with heavy handed tactics leaving our people confused what to do. The Ombudsman Commission should clarify with the Royal PNG Constabulary if Governor has been following due process in deploying Police in the Province who have constantly been intimidating and harassing the public in the Province. The Province is plagued with flooding and cyclones frequently and our physical infrastructures have deteriorated sending the Provrnce 20 years back. This whoes have escalated further with Governor illegally placing a moratorium in all land dealings in the Province.

All subsequent economic developments face the same illegal wrath, as 99% of all resources developments both renewable and nonrenewable are without question all land based and this is frustrating the resources owners who want to map out their own resources development with their investment partners. Although his actions are unconstitutional the people mainly those of us in
the Sohe District stopped and have waited for Governor Juffa to present us his alternative development investment models. We suppose these models are still under design in the US State of Washington particularly in the city of Seattle. His leadership has been all about deception and constant disappearance, to the United States of America or Brisbane, Australia and rhetoric's, hallucinations and fantasies in the social media about ideals that have no legs to stand on. In this modern day and era you can run as far as you can but you wont hide and lie, to us your faithful people who looked to you for leadership in vain.

 There is no "DEVELOPMENT STATEMENT" or no coherent or logical, developmental agenda he pursues. Nothing Governor does in the Province is consistent and sustained as such where certain
result may be achievable and our minds are in complete confused state. He cannot connect his political mandate duly given by us voters with true leadership that effectively addresses result
oriented developmental issues facing the Province.
ALL THESEMAY BE ATTRIBUTED TO ONE THING AND THAT IS HIS UNPRECEDENTED CONSTANT ABSENCE FROM THE PROVINCE AND THE COUNTRY

Our final request to your good Office the Ombudsman Commission of PNG is to investigate how Governor Juffa was able to live out the Greatest of Contradiction. He has flooded the media both in the print, television, facebook etc. preaching and vowing to FIGHT CORRUPTION AND ILLEGAL BUSINESSES AND INVESTMENTS AND FOREIGNERS CONDUCTING BUSINESSES ILLEGALLY WITHOUT PROPER WORK PERMIT IN PNG AND YET HIS WIFE HAS MADE MILLIONS OF KINA UNDER PNG PROJECTS SERVICES LTD WHICH, HE BENEFITED FROM ALL THE WHILE SHE OPERATED ON TOURIST VISA. She has .never had any work permit issued by the Department of Labor and Employment under PNG Project Services Ltd and therefore under the laws of the Independent State of Papua New Guinea she had no authority or legal standing what so ever to engage into business in PNG. This is a prosecutable offense under PNG laws especially when PNG projects Services obtained a Customs Contract underserious circumstances of.
impropriety.

It is normal Government practice to ensure entities or persons with whom State enters into Contract are certified to have all statutory compliance fully adhered to. In this case PNG Customs Services were duty bound to ensure appropriate work permits were in place however, we can understand why it was nol done. Governor Juffa was the head of PNG Customs Services then and only he alone would answer these questions for the Ombudsman Commission of PNG.

We further seek the Department of Labor and Employment to investigate Governor Juffa's wife Ms Amenda Manelick Sprang whether she had appropriate Work Permit under PNG Projects Services Ltd to make those highly questionable millions from PNG Customs Services. If she has breached the Laws of the Independent State of Papua New Guinea we, pray that those involved be dealt with by the Country's laws like everyone else and brought to justice.

Lastly, we pray that the Ombudsman Commission of PNG take our complain and give it serious treatment as we suffer in the Province while our Governor travels and lives lavishly overseas at the expense of the State Revenue illegally siphoned through PNG Project Services Ltd.

Just a short note regarding an article recently about Governor Gary Juffa. I encourage the effort to fight corruption but let us also make an effort to ensure we do not inadvertently assist those who perpetrate it. This is certainly the case here. I will not ask you to take down this article because I really cannot influence that. People can read and make up their own minds. Sadly, many will believe the lies here. That I cannot help.

 Time will reveal all.

 However, I can assure you that the allegations posted here are all lies and fabricated untruths and I can prove that and I shall when investigations come to that stage. I believe that this has been referred to the Ombudsman so I await their directions and the opportunity to clear my name and these lies and not attempt to influence any investigations using social media or public rebuttal other then to say these are "lies", the work of evil men who seek riches at the expense of our people. In fact, these lies are perpetrated by the very people I am taking to task over in Oro for illegal logging..

I know exactly who they are...these characters have sold 300,000 hectares of the peoples land to an asian firm for K10 million under the SABL Agro Forestry Scam and I have stepped in on behalf of the landowners to stop this heinous deal. I have gone as far as Singapore and reported them to the RSPO and they have intervened to issue a stop work notice. I have taken the matter to court and most recently their application to dismiss my proceedings was put aside so we are succeeding in court and I cannot speak as it may be sub judicial.

 Time will reveal all.

 The characters have pleaded with me to put aside my case and sell my people out - I have outright refused. I will not be bought off, I will not be stirred or shaken by false allegations and the threat of rhetoric and gossip. I will fight to the very end for my people, if it means we must fight corruption physically and with vigor and necessary aggression, then so be it. I am ready to do that and face the consequences. It may be a long and hard fight, but it will be worth it all in the end for our nation and future generations.

Poor Professor Pumwa, Poor Prime Minister O’Neil, The Truth Came Out Sunday

If anyone thought that the acting VC could keep important government secrets or was cool under pressure, it all went out the window last Sunday at the East Taraka Baptist church.
The regular pastor was out of his mind to ask Professor Pumwa to speak.
Professor Pumwa talked more than an hour to the congregation but hardly spoke of the holy spirit or taught the holy words of the Bible.

He forgot the purpose of the building he was speaking in.
Professor Pumwa used this special opportunity to celebrate the Lord and instead gave a political speech full of ego.

Professor Pumwa made East Taraka Baptist church into a political gossip house last Sunday.  He turned his face on Jesus Christ by speaking mostly about himself, his political connections, and how good he is.
Professor Pumwa bragged about his tight connections with the Prime Minister O’Neil.
To fellow Baptists he boasted that Peter O’Neil had given him his blessing to become VC.  Professor Pumwa said that because the PM gave him the power, he will continue acting on the post no matter what.  He said that the PM said he put all his trust in John Pumwa.

Professor Pumwa went to far to say he is part of government, and most qualified to take the position.
Professor Pumwa will need a very extended conversation with God through prayer to beg forgiveness for blaspheming the sanctity of the church last Sunday.

The church is not a place to play politics. Whatever our PM said to Professor Pumwa was something for Professor to keep in strict confidence not talk about it to anyone. 
Those who know him well have always said that Professor Pumwa is fine when happy but can never keep a secret when he gets upset. 
Most heads looked down at the floor in embarrassment at Professor Pumwa made his inappropriate political speech.

Professor Pumwa told the congregation that Unitech doesn’t need foreigners, don’t need white man such as Albert Shram.  The racist comments he made in the House of the Lord was another blasphemy that God will hold him accountable for.
Probably Professor Pumwa should talk directly to the foreign teachers at Unitech so they are clear about the VC’s feelings about them.  He seemed to think that giving his speech to nationals in a small church would keep the secret safe. 

What the Professor did not seem to understand is that his fellow church members think it is more important to follow what the Bible teaches us about how we should treat each other as fellow human beings than what Professor Pumwa thinks about white people.

On and on went the bragging inside the church.  The professor boasted that he had applied for the VC job when Albert Shram also applied.  According to Professor Pumwa his presentation was the best of all the candidates and he should have been made the new VC.

Professor did not bother to tell everyone that the hiring committee was mostly made up of nationals, not foreigners.  They decided to hire Albert Shram, not Professor Pumwa, probably based on qualifications and not impressive speeches.

Professor Pumwa’s very mediocre accomplishments during the past year may explain why the hiring committee picked Albert Shram instead of him.  Or maybe they knew about Professor Pumwa’s weaknesses.   

Albert Shram must be told when he comes back that Professor Pumwa is a snake in the grass and should never have been promoted by Albert Shram.  All because of last Sunday’s sermon at the East Taraka Baptist church when he spoke of his lust for power, his dislike for foreigners, and his appointment by Peter O’Neil to be the new VC no matter what the law says.  Professor Pumwa’s true feelings all came out in church.
If Professor Pumwa was speaking truth when he said that Peter O’Neil said that Professor Pumwa would get the job, the PM should be told that anything he tells this Acting VC will get out in the open at some point.
It is requested that PM O’Neil come to Unitech and talk to staff and students so he knows what he is getting in to.

Those of you at Unitech probably already know about this incident on 2 March. If in doubt seek out on of the Baptist church members to confirm that every thing I am writing about is true.   Let Professor Pumwa dare write a reply to deny any of this report.  God witnesses all and knows who lies and deceives and says one thing to one group of people and the opposite to another group.  God will know if you play word games to let you deny what you did on 2 March.

Such ungodly behaviour in the House of the Lord must be condemned by the congregation as it reflects badly on everyone.  Remember God is our witness and He sees not only Professor Pumwa’s actions last Sunday but also sees if no one in the East Taraka Baptist church will raise a finger to protect the holy sanctity of the church and condemn Professor Pumwa’s actions.

WHO CAUSED THE PUBLIC HUMILIATION OF HERST MINISTER DELILAH GORE IN LAE?

Who set up poor Delilah Gore for public humiliation last Thursday in Lae?  Only a deaf mute would not have heard that Unitech students were demanding either yes or no answer for the return of Albert Schram.  The students stated repeatedly that they would not negotiate.  Under those conditions the new Minister for HERST would be insane to fly to Lae if she had anything to offer but a yes answer that Schram was now allowed to come back.

The trip quickly became a public relations disaster.   Once she arrived, Minister Gore wouldn’t come to Unitech, because of “security concern” (why didn’t she have that concern before she left Moresby?).  Then she requested student leaders to come to the NARI compound outside Lae to talk.  That was an invitation reminiscent of the government’s close door invitations last year to the SRC president.  Those secret meetings resulted in a strange 180 degree turn in the stance of the SRC president.   SRC leaders didn’t bite this time at the invitation to bribery or intimidation.

Minister Gore arrived at Nadzab and established her communication headquarters at NARI.  Then came the embarrassment of Acting VC John Pumwa being blocked by students as he tried to exit unigate.  Where was the Acting VC going?  To a closed door meeting with Minister Gore and the Unitech Council, of course!

To top it all off, Minister Gore met with the sources of all evil at Unitech, the deposed Chancellor Philip Stagg and Ralph Saulep of the former Unitech Council.

Plenty secrets in Lae on Thursday and Minister Gore was at the centre.

The lasting impression of the trip was that at best it was nothing more than another delay tactic, complete with more closed door meetings (always the preferred tool of people who have something to hide).  Thankfully for PNG, Unitech’s students were not impressed. 

In view of the Minister Gore’s strong statements earlier in the week that she would solve the Unitech Saga once and for all, the poor lady earned one big mud pie on the face from her visit to Lae.   It is clear that she is over her head and she has no solutions to Unitech Saga that involve the return of Schram.  Her bag of tricks consist of nothing but the same government deceptions that created the Saga in the first place.

Being as ignorant about Unitech Saga as the Minister now shows herself to be (witness her verbal stumbling during the EMTV interview last Wednesday), Mrs Gore obviously needs advice on how to solve the problem no one else has been able to solve.   Obviously she would first turn to resources within HERST.  Obviously she is getting very very bad advice from those resources.  Who might they be?

First on the list is the infamous OHE Director General David ‘Koward’ Kavanamur.   Kavanamur is the supposed top dog intellectual of OHE whose extensive learning never seemed to send a warning flag to his brain that the boss (David Arore) he used to so willingly cooperate with was an incompetent womanising unpredictable alcoholic.  Even the Prime Minister came to see that Arore was a disaster, which is why he booted him out of HERST last week.   David Kavanamur, on the other hand, helped keep the idiot in office since 2012, propping him up with all necessary support to help Arore create an illusion of competence.  At Arore’s departure party two weeks ago, Kavanamur saluted the sacked Minister’s great positive impact on HERST.

Please, David Kavanamur.  Don’t make us vomit!  Have you no shame?

That is correct.  ‘Koward’ Kavanamur has no shame.  To understand why, discover his current situation.  You see, Nationalist PNG patriot Kavanamur doesn’t even consider himself a resident of PNG.   Years ago he nicely settled his family into a house in northern Queensland (could someone over in Oz supply us a photo?), which he commutes to by jet from his job in Moresby.  That kind of lifestyle costs money, lots of it.   ‘Koward’ Kavanamur earned his nickname because he won’t speak out in the name of justice because of his addiction to the lifestyle of the rich and famous.    In layman’s language, he has sold his soul to the devil.

To protect his self interests, Kavanamur has become a man who talks a lot and says nothing. Nowhere was this more evident than when he appeared on EMTV news a day before the ill fated trip of Minister Gore to Lae and talked about factors and factors, including politics and more politics, which he said affected any solutions to the Unitech Saga.  At no time did Kavanamur offer a single detail to explain anything he was saying. 

One of Kavanamur’s most unconscionable statements was to allude that Judge Mark Sevua’s objectivity in his report had been corrupted by different interests.  What Kavanamur failed to mention (purposely?) was that any unfairness that existed with respect to the Sevua investigation was unfairness against Unitech VC Albert Schram.  The investigation’s terms of reference was written mostly by Anti-Albert Schram former Pro-Chancellor Saulep, a slimeball lawyer who in collusion with former Chancellor Stagg, milked Unitech for years to fund personal pleasures.  

Five out of the six terms of reference for the Sevua investigation were purposely stacked against Schram.  Despite this bias, Judge Sevua managed to achieve great objectivity in the report, letting the cards fall where they should.  The Sevua report’s cards fell in a pattern that clearly pointed to years of corruption under the Stagg-Saulep-Baloiloi Unitech management triangle that needed investigating.  The report furthermore vindicated Albert Schram of any wrongdoing.

Kavanamur (purposely?) failed to mention any of these specifics.  Let’s review another specific about ‘Koward’ Kavanamur.  Since he became Director General, Kavanamur has presided over a steady decline in PNG’s universities and should be thoroughly ashamed about that.   But wait.  David Kavanamur has no shame.  He can school his kids overseas and escape to Cairns whenever the going gets rough in Moresby.   Whatever disasters he creates for PNG's institutions of higher learning won't, in the end, affect David Kavanamur nor his family.  For shame, for shame.  Ooops we forgot.  'Koward' Kavanamur has no shame.

Miinister Gore, we suggest you find other sources of advice how to resolve Unitech Saga than a man who’s advice is as honest as his escapism to Cairns.   Why not start by consulting with the students and staff of Unitech?

PETER O’STEAL STRIKES AGAIN! - USD$1.2 BILLION CORRUPT LOAN.

The Prime Minister Peter O’Neill (‘aka O’Steal) has personally and unilaterally directed that the State of PNG borrow US$1.2 Billion Dollars through international financiers syndicated by the Swiss UBS Bank, to buy 10% of Oil Search Limited (OSL) shares. It is believed this transaction is motivated by personal gain. Therefore, this loan is believed to be for a corrupt outcome. This corruption is perpetrated by UBS and other international banks lending the money.

PNG does not need the loan. It is Peter ONeill who needs the loan for his own corrupt gain. He is using the country’s assets to obtain a personal benefit. This must be made very clear to the international lenders. On this basis no future PNG Government will be liable to repay the funds, lent for an illegal purpose.

As of this article the international lenders will be deemed to be aware of the allegations I make here.( I invite the Prime Minister to contradict me if he can).

This is not an ordinary share purchase (investment) made by the Prime Minister on behalf of the people of PNG. What I am about to reveal is only known to a few key people in government circles.

In 2013 Total, the French Petroleum conglomerate entered into a deal with InterOil Limited wherein it purchased 60% stock in InterOil with the intention to develop the Gulf/Elk-Antelope LNG Project. Total bench marked the price of the InterOil shares against the known oil and gas reserves of InterOil’s Gulf/Elk LNG reserves, and international price indicators.

Interoil was started by two men in this country, Phil Mulacek and Gayland Baker in early 1990s. These two men, one a Texan and the other from California walked into Port Moresby government offices with empty brief cases promising to build an Oil Refinery in PNG out of one abandoned by Chevron in Alaska. While Curtain Brothers offered the Motukea refinery, these two men with very slick marketing skills, and Gayland Baker’s position as a director of conservative Fuller Christian Seminary, gained the upper hand.

The rest is history, of the way they manipulated government decision making processes, public announcements, to gain every benefit, favour, approval, license and a free lift up in every other step of that company’s development.

Interoil today is testimony to how Phil Mulacek has carefully and deliberately manipulated the goodness of the people of PNG and their government, how he has ruthlessly and unscrupulously exploited the weaknesses of key leaders of PNG, to build a personal fortune worth several hundred Million Dollars for himself and his extended family. Mulacek has been ably assisted by Christian Vincent, the Frenchman, his brother-in-law who acts as Phil’s main go-to man who has also gained in the hundreds of Millions.

In a small town things can get a bit incestuous, as Christian Vincent’s long term girlfriend in PNG happens to be the Fijian-Indian Lady with the short skirt who is the CEO for Peter O’Neill insurance company. Peter O’Neill is no stranger to Vincent and Mulacek having had many private dinners and meetings over the years when Mr O’Neill was a Minister in the Somare Cabinet.

Having sold 60% of InterOil to the French Company for several hundred Million dollars, Mulacek and co have been holding out the balance of the shares of 40% for a price that is almost triple what the French have paid for per share previously. The French having pre-emptive rights could not pay the price that the Mulacek camp has been asking for the balance of the shares. Meanwhile the Gulf-Elk LNG Project is not going anywhere fast.

The Mulacek camp have been trying to play Total against Exxon and Oil Search Ltd, who both also expressed interest in a piece of the action. Mulacek had hoped Total would pay the price to own the whole lot or Exxon would pay a premium to participate. No one took the bait. Over the years people have become tired and weary of Mulacek and his antics, always trying to profiteer and gain unreasonably, when he came to PNG with nothing. The InterOil project could have been fully financial 5 years ago had Mulacek not been greedy and held out.

This game has developed into a stalemate with Total holding majority stock and cant fund the project until it took the rest of the stock. It required a game breaker.

This is where the creative genius of Phil Mulacek came to the fore once again, and perhaps for the last time against the people of PNG. He approached Peter O’Neill through the lady with the short skirt for a private meeting. In that meeting it was laid out to ONeill that someone should assist Oil Search Limited (who has expressed interest ) to buy the balance of the 40% shares in Interoil for the exorbitant price that even Total would not pay. That Oil Search Limited had already been sounded out on this, and provided someone funded OilSearch Limited for the price of the Interoil Shares they would do the deal to further fortify them against any corporate raid. The State of PNG taking the shares would surely be a poison pill for the Dubai based Arabs seeking to do a raid on OilSearch Limited. The aggregate agreed price for 40% InterOil shares and OilSearch 10% shares was in the vicinity of USD1.0 Billion with enough fat to go around.

What was put to O’Neill in that meeting was that if he could get the Government of PNG to borrow USD$1.2 Billion from international commercial lenders, and buy 10% of Oilsearch Limited shares, Oilsearch Limited would use the proceeds definitely to buy the 40% shares from Interoil at its ridiculous asking price, AND THERE WOULD BE A VERY TIDY KICK BACK OF USD$100 MILLION FROM MULACEK & CO TO ONEILL for making this happen.

This was the game breaker. ONeill became the game breaker. He became Peter O’Steal.

Having shook hands on the deal in last quarter of 2013, Phil Mulacek has been working feverishly with Peter Botten of Oil Search Limited, to get international lenders to lend to the State this huge sum of money, while Peter ONeill has been carefully moving the right people into right places to take the decisions for him, and to cover his arse in the State agencies. The last act was to move the Minister for Petroleum William Duma aside and put his own man Duban in place to approve the deal. ONeill knew Duma would see through the deal as unfair, unreasonable and corrupt and not approve it.

This week Peter ONeill has had lawyers and Financiers and bankers camping all over town feverishly working to finalize the deal. The only Minister working closely with ONeill to close the deal is Ben Micah, who will support ONeill because he needs ONeill to turn a blind eye to his own stealing.

Most of the Members of Parliament in the Government side do not know about this very juicy and lucrative deal that is going down just this week.

In fact most of the Cabinet Ministers do not even know. The Opposition does not have the manpower or the resources to keep up with Peter O’Steall’s very active life of carrying on private business deals while pretending to be Prime Minister of Papua New Guinea. Only a few people close to him only know some of the deals, but not all.

This Prime Minister has made more money using his position as Prime Minister of this country than any other leader in the history of this country, and that folks, is the understatement of the Century. Nothing over K10 Million passes the Tenders Board, for example, without the Prime Minister getting a look in first. His fingers are so sticky that it is now common knowledge among all his Coalition Party colleagues that this man is not good for PNG.

Papua New Guineans need to ask, and ascertain very clearly that:

1. The State does not need the 10% of OilSearch Limited Shares. Oilsearch Limited is a public company. It can bloody well raise its own money and buy the shares. When Peter Botten was first approached to buy the Interoil shares he baulked at the sale price as he knew what Total paid. Interoil was asking far too much. When he was again approached with State Offer, he realized it would be a poison pill to have the State to hold substantial shares in OilSearch, so he happily agreed. Oilsearch quickly overpriced its batch of 10% shares and was also gaining from the sale of the shares to the State. Everybody gains from the State.

2. The Deal and the Loan is not in the best commercial or financial interests of PNG and its economy. The Country has already pledged its assets, including the previous Oilsearch Shares (18%), to the Dubai based financiers of our LNG interests. Why borrow more to get into debt with Swiss Banks this time and park the interest encumbered (shares) in the same commercial entity (Oilsearch) that the Dubai lenders already have priority in call over? Putting all our LNG eggs (revenue stream) in one basket is not a wise move.

3. Why didn’t Peter ONeill opt to use the money to allow the State to exercise its option to acquire 22.5% of the Gulf Elk LNG Project?

4. Why is Peter ONeill helping to protect OilSearch which is a public company- unless there is a catch?

5. Has Peter ONeill relied on a fair and commercial valuation of the shares of Oil Search Limited to justify the price, despite the prevailing share price? Where is the professional valuation?

6. Why is Peter ONeill borrowing USD1.2 Billion to fund shares when the money can be best spent on health and education and infrastructure?

7. How can the PNG economy which is already burdened by debt and currently underpinned by 2 consecutive years of massive budget deficits afford to shoulder this huge debt burden? Why has Peter ONeill further mortgaged our future?

8. Why has Peter ONeill further exposed the PNG economy to the LNG Project. All the hopes of the politicians are on the LNG Project. This is a huge and monumental gamble; particularly because the State has failed to honour its agreements with the Landowners, and the State ( Arthur Somare) has failed to explain what happened to the 3% of the State’s 22.5% in the PNG LNG Project. What happened to the 3%? Mr ONeill was Finance Minister. He knows what happened to the 3% in the Dubai deal. Perhaps he can explain? The Landowners will not allow leaders to trick and mislead them anymore. They are wiser by the day.

9. Why didn’t Peter ONeill allow the USD1.2 Billion to be borrowed by Kumul Holdings or National Petroleum Company or even the IPBC, for it to buy outright the shares of Interoil? Why gift Oil Search Limited this money at the expense of the people of PNG? Why does OilSearch have to own the InterOil Shares (thereby the Gulf-ELK LNG Project) when the State could easily acquire it and own it- and not for that price!

10. What is the underlying rationale and underlying value in the exorbitant price (of the loan) of the InterOil Shares? Who has done independent industry benchmarked valuations based on which Peter ONeill has agreed with Mulacek to do this deal?

11. What is the nature of the Mulacek-ONeill kickback and how was it designed to be delivered?

12. Is it true this major investment decision worth approximately K4 Billion was made by one man, Peter ONeill, without Cabinet or Parliamentary approval or debate? If so then it is clearly an abuse of the office of the PM, and he should be referred to the Ombudsman for investigation.

There are many things absolutely and seriously wrong with this investment decision. The Prime Minister has no power to unilaterally commit this country like he has done with Manus Asylum seekers etc. It has become abuse of power. He has become dictatorial.

ONeill is currently getting government agencies and Departments to approve this transaction for which even the Finance & Treasury officials and the Bank of PNG have not done any formal prior appraisal of this loan. He is trying to rail road the proper government agencies to approve this transaction, when they haven’t even done any proper evaluation of this loan against the country’s other commitments and debt levels.

I call on Ministers of Cabinet, Government Coalition Partners and Leaders to demand full briefing on this transaction, and all documentation on this transaction be tabled in Cabinet and Parliament for public scrutiny. I call on the Cabinet Ministers and coalition partners to block this stupid loan.

I call on Senior Ministers to feel sorry for this country and its people, to take their oaths to serve the people seriously. I call on responsible Ministers to stand firm and not endorse this deal even it means their sacking. It is time for principled leaders to stand up to this PM and his greed.

Already the PM has set it all up so that he does not sign any documents himself. He is using quiet pressure through other people including, once again Ministers Marabe, Polye, Micah and Duban to sign and endorse this deal that Parliament and Cabinet did not approve. Even if Cabinet approved it, it seems they would have been mis-informed. When the shit hits the fan, the PM will naturally go after these Ministers and once again, blame them, as he did with the Paraka deal.

This is a stupid deal, designed to benefit a few greedy and selfish people. IT MUST BE STOPPED!

The Prime Minister needs to declare his interest in this matter publicly and resign. He has taken far too much from this country and the small people. He has to learn that enough is enough!

Overwhelming Evidence of Unitech Management Secret Undermining of Unitech Student Fight For Justice for Schram and a Decent Education

There is growing evidence of a conspiracy between members of government and Acting VC Professor John Pumwa in particular to prevent the students from winning their fight for fairness and justice for VC Albert Schram.  

The first evidence was the very unconvincing presentation given by Pumwa, along with Pro-VC Macquin Maino and Registrar Veronica Thomas at the student organised forum on Friday 28 March.  They kept giving as their excuse that they had to work within their job boundaries.  They neglected the reality that anyone who cares can speak out as private citizens (apologies to one or more of them if they have been writing under pen names some of the excellent articles published on pngblogs over the past year).

The second evidence was John Pumwa’s strange “sermon” at his church on Sunday 2 March. At that time he indicated that a deal had been struck between him and O’Neill to bypass Schram and make Pumwa permanent VC.  He apparently went into great detail to explain to church members why he and not Schram should have gotten the job in the first place.

The third evidence was the Thursday 6 March arrival of OHE Minister Delilah Gore and OHE Director David Kavanamur and their secret meetings with the Acting VC at NARI.  The hope that student leaders would participate in the closed door meetings was fortunately turned down by the students themselves who now realise that it was a trick to get them to give up their boycott, in the same way as what happened when SRC president Livingstone Hosea last year had meetings in Moresby then came back and suddenly stopped the boycott without convincing explanations.

Now comes the fourth and fifth pieces of evidence on Monday 10 March.  The Acting VC held a secret special meeting with HODs to discuss the boycott. Shortly afterwards he held a meeting with governor Kelly Naru.  Once again behind closed doors and no report on what was actually said.

There is no doubt anymore that the SEM has been playing games with students and staff.  Pumwa and Maino, at least, only pretend to be on the student’s side.  John Pumwa in particular has said loud and clear the same message, sent to many pairs of ears, that the government has decided that Schram is not coming back and Pumwa has been appointed the new permenant VC.  He has never said this to the students and come clean.

If the students are not able to stop the disaster we will call John Pumwa, the future for all of us at Unitech will be

Continued deterioration of Unitech’s learning infrastructure and even worse education for current students compared to previous years.

A long, international shaming of our country by international audiences, donors and others in protest at the low priority Unitech SEM and PNG government has for guaranteeing justice and basic human rights and justice of people in the country.  The evidence will be the bad treatment of Albert Schram left abandoned for over a year by an uncaring population.

Leadership without vision for Unitech, continuing the misty Baloiloi tradition of 18 years for however many years Pumwa remains the VC.   Expats will leave in disgust and the dream of an international style university with international exposure and ideas flowing into Unitech will be over except for Pumwa’s cheap words and empty promises.

 A green light for corrupt former and present staff at Unitech that in PNG you can steal and never get punished, you can run out opponents especially expatriates and come out on top.   A green light for all our white collar thugs and money stealers to continue destroying this country.  No matter what the PM says, Peter O’Neill himself has no interest in honesty or justice for our people but wants all alternative viewpoints silenced while he fills his own pockets.   We now see from the Sengi report that the Unitech SEC has barely moved in implementing its recommendations for prosecution.

 There has never been a time in the history of PNG where the nation’s future relied so critically on the actions of our uni students.    Over the next 3 weeks it will become clear if this year’s Unitech students are unique and special.

We will see if they are willing to sacrifice personally for the benefit of PNG or prove to be no different from students before them whose inattention and unconcern let Unitech slowly fall apart. 

They are our main hope to stop our PNG's downward slide into dictatorship, corruption, fixed elections, do nothing people, falling apart infrastructure, and everything else that can be seen in small scale at Unitech.

Please pray that our students at Unitech will do the right thing and will not give up.  The clock is striking the deadline for Schram to come back is only 20 days away.

Is Peter O'Neill's days as PM numbered after Polye, Maipakai and Duma's sacking?

For those you who think the recent sacking of William Duma, Don Polye and Mark Mapakai will in the short term result in the PM's removal think again.

The following comments were posted in a debate between Sonja and myself back in January 2014.

Actually there will be no interesting days ahead, any suggestion that a reshuffle in Ministry will result in PM's removal again is misconceived. Technically by law PM controls appointments to NEC. NEC has the power to make executive decisions or resolutions on behalf of the Government and the people of PNG.

If in the case where members of the NEC are challenging the PM's decision's or failing to tow the line he has the power to sack them and have them replaced with anyone of his choosing. (Hence Duma and Polyles recent sacking).

In other words the PM could sack every other coalition MP Minister and appoint all PNC MPs. And not a single MP, Party, Parliament, GG or Speaker can do anything about it. He is protected by the 30 month grace period. Come Jan 2105 when the 30 month expires that will be another story when parliament will have powers to remove him.

Those of you who's hopes rely on the arrest of the PM in relation to the Parakagate Saga to force his removal think again. The arrest of the PM will not provide a vacancy his opponents are hoping for. There is no law that provides for it.

To be honest any arrest or charges against PO over the Paraka Saga will go nowhere, arresting someone on allegations of committing an offence is one thing, convicting them for it is another...

If arrested it will only mean the he has been charged by the state for allegedly committing a crime. He will be given the right like any other citizen to defend those charges and will remain in office until proven guilty and convicted of the charges. This process will take a minimum of two years if not longer.

Paul Tiensten was arrested and charged back in Nov 2011 and was found guilty in Nov 2013 exactly two years later. However he is yet to be convicted (judge to sentence him) He was never forced to stand down or suspended from office.
In his case he admitted to signing the documents where as the PM is disputing signing the letter.

A trite principle in law is "he who alleges shoulders the burden of proof and the standard of proof in criminal offences is beyond reasonable doubt" The claim the forensic experts have proven O'neill signed the letter is circumstantial without the benefit of the original letter. The only evidence is a photo copy of it, a simple defence to this evidence is that someone photo-shopped his signature and pasted on the face of the letter.

Further a key element that needs to be proven (which the signed letter cannot ) is "mens rea" or criminal intent, merely signing a letter will not suffice to meet the required standard of proof to proving he knowingly signed it with criminal intent.

If you re-call only recently a prominent businessman Garth McIllwain former CEO of BSP was arrested and charged for purportedly forging a legal document. In the end the court dismissed the charges expressing the view the public prosecutor failed to establish the accused acted with criminal intent knowing that the documents were fraudulent when he signed them.

To secure a conviction against the PM the Public Prosecutor would need to prove that he either acted with criminal intent or benefited from the K71.8m in cash or kind. Without this key element of the offence the charges will ultimately fail.

There is the assertion that during the course of the prosecution of Paraka, Paraka himself will turn State witness to give evidence against the PM and establish the link. Firstly Paraka would have to be found guilty of fraud that process in its self would take more than two years and secondly the payment of K71.8 million is yet to be proven to be illegal.

If I was in the PM's position I would simply walk into the Boroko Police Station make myself available for questioning ask to be arrested if the police believe there is probable cause. Apply for bail and walk out. At the committal hearing before the district judge I would make an no case application confident the magistrate will dismiss the charges putting an end to the whole issue.

When a person is charged of a criminal offence the charges are first heard in the lower court (district court) by a magistrate, as to whether the evidence is capable of a successful prosecution, (prima facie case) If the magistrate does not believe the evidence is sufficient he will dismiss the charges. If the magistrate believes the evidence is sufficient the case will be committed for trial in the National Court.

Without the benefit of the PM's original letter or any witnesses to attest to him signing it the prosecution will fail to establish a prima facie case. As I previously explained the PM's council/lawyer will simply argue that someone forged his signature or copy paste it onto the face of the letter. Even with the benefit of the original letter the prosecution would need to prove there was criminal intent on the PM's part that he knew the transaction was illegal and still knowingly facilitated it. The court is yet to determine the payment of K71.8m to Paraka is illegal.

The moment the magistrate dismisses the charges in the eyes of the public PM will come off looking innocent and two making his opponents look foolish. This would make any future allegations harder to sustain in the minds of the people and law enforcement.

The point of whether the coalition would accept PO continuing in office if arrested is irrelevant. With the 30 month grace period in effect he can't be removed. Unless he chooses to resign or was convicted (more than 2 year process). I can't see that happening any time soon. After the expiry of the 30 month period being Jan 2015, ten months from now yes parliament can vote for change in the PM's post.

Of course there is the current court challenge to the 30 month grace period being unconstitutional. I was in the court on a separate issue when I witness the full bench rule in favour of Illa Geno having standing to challenge the constitutionally of the 30 month grace period. My honest opinion based on the recent the court rulings on OLIPAC and the proposed changes to the Organic Law on Ombudsman Commission being unconstitutional the court will do the same to the 30 month grace period. With the courts having a keen interest on such matters a ruling could be forthwith in three to six months.

So those parties that have a vested interest to remove the PM the only shortest option is to wait until either the Supreme Court strikes out the 30 Month Period or when it expires in Jan 2015.

However don't expect the PM to just sit back and let it happen. It is one thing to achieve an outcome unopposed, its another to achieve an outcome against an opponent with a war chest of funds and the full resources of the PM's office, not to mention being politically ruthless and cunning enough to do whatever it takes to oppose his removal.

I say all of this to put the issues in perspective and to avoid misunderstanding so people are clear about the facts.

John Pumwa, youre to blame for what is now happening at Unitech

Students and staff were shocked to find out that you've been promised the permanent VC job by O'Neill and didn't decline as a matter of principle.  You were content to take the power silently and pretend to be a Shram supporter.  You became a Judas to the principles of justice and truth.

You got your deputy Maino to do help you by joining your cry that you as a national could do this job better than the foreigner Shram.  You used deception to try and fool staff and students.

You thought that your friends, colleagues and church members would accept that truth and justice should be pushed aside so that you could follow Oneil's bidding and let Shram rot in Australia, hopefully waiting that PNG would treat him fairly. John Pumwa you deserve to rot in hell for what you have done against truth and justice.You never communicated effectively to students and staff even before this whole issue blew up.

You waited for people to come to you instead of you going out to the staff and students and because of that you never realised the growing anger on campus.  You made yourself blind and that is your fault and no one elses.

You and your executive management staff never bothered to refute or reply to any allegations made against you when you could have turned things around.  You cannot complain that misinformation is being put out about you if you fail to defend yourself. 

That is your fault. You and your management are so out of date with the modern world that it completely escaped you of the power of the social media.  You could have used it to mount a healthy debate about who was telling the truth and who was not.  You and your staff never did.  You all ran away from the social media.  That is your fault.

The obvious conclusion is that you ran away from the allegations because the allegations were true.  You are still running away.  It is time that you save Unitech further suffering and disruption by
stepping down, along with your deputy Macquin Maino  Both of you have brought incredible damage to this university because of your constant mismanagements and failure to act in the name of truth and justice.

Justice always prevails, John Pumwa, only you don't seem to recognise it. You have created this mess by not working genuinely for justice. Stop putting your selfish interest first, stop joining the devil
against good and innocent people and start doing whats right for Unitech.  

RESIGN AS ACTING VICE CHANCELLOR

Kelly Naru overlooked the most important current Uni-Tech issue: Albert Schram

Morobean governor Kelly Naru spoke with students at the PNG University of Technology late on Monday.   From eyewitness accounts, it seems that the governor thought he said all the right things, trying to be popular and soothing. 

He assured students that he would write the government to ask for the Sevua report to be released.  He did not promise that he would make a public statement to this effect. 
This lapse is evidence that the governor is not prepared to make a real commitment.

Nevertheless, it was too little action, too late.  Voices from all corners of the country for months have written or spoken out months and months ago that the Sevua report should be released. The governor
is about 10 months out of date with his focus on Sevua.  Releasing the Sevua report is unimportant.  Without seeing that report we already know the extent of corruption under the former Baloiloi administration thanks to the Senge Report released on PNGBLOGS.COM.

 If anything Naru should have demanded that the Uni-Tech administration carry out a more comprehensive internal investigation of corruption at Unitech during the previous regime.

The governor has accidentally or purposely overlooked the biggest issue of all in the Uni-Tech Saga.  All who have read and made public statements about the Sevua report (except for former Council member Ralph Saulep) say that the Sevua report finds VC Albert Schram is innocent of all charges.   On that basis, Uni-tech Council last December voted without opposition to endorse Albert Schram's return to PNG and Uni-Tech. 

Since then, Schram's return was endorsed by many groups including Uni-Tech staff and students.  The only obstacle lies within the HERST ministry under the new minister, but more importantly
within the Migration office and whoever is dictating its actions from above. There is no court order against Albert Schram coming back that has been reported.

The only remaining obstacle lies with the government. Their excuses for creating this obstacle have been vague and unconvincing. Governor Naru needs to get up to date.  Whether or not the VC Schram is allowed to return will say everything about the capability of our nation and our people to do the right thing and ensure justice for all.

A FIGHT WITH CHANGING ENEMIES AND INTERESTS

WHO IS THE REAL CAUSE OF THE ONGOING PROBLEMS AT UNITECH –STUDENTS, STAFF, STAGG/SAULEP TEAM, BOGAN TEAM, SCHRAM, ARORE, GORE, KAVANAMUR, PUMA OR O'NEILL?

The PNG University of Technology is the only premier university of its kind in the country which has produced many leaders in all fields and walks of life. The issues surrounding the removal of Prof Albert Schram dates back to late 2012 and as it now appears so visibly, the Government did not address them but aggravated them.

At first, I thought then Minister for Higher Education, Hon David Arore was the cause of it. But now it is apparent to thinking people that Arore was playing to a far more entrenched conspiracy to install a kindred to the position of Vice Chancellor. Let me invite you to read between these lines.

Unitech is no ordinary Uni. It is governed by the University of Technology Act and has its own Governing Council. More so, it has its expert consultancy firms which generates considerable internal revenue and receives development funds from the National Government annually more than other Unis. Unitech has had its longest serving Vice Chancellor, Dr Misty Baloiloi whose reign coincided with Philip Stagg as the longest serving Chairman of the Governing Council. Dr Baloiloi resigned in 2011 to go for the 2011 National General Elections which he did and subsequently failed.

Prof Schram was appointed as the Vice Chancellor of Unitech by the Stagg/Saulep University Council to fill in the vacuum left by Dr Baloiloi. At that time, there was growing resentment and suspicion amongst the students and staff about how funds were being used by the University Council and the Administration of Dr Baloiloi. The Stagg Council thought that appointing someone from halfway around the world in the likes of Prof Schram who had no knowledge of the prevailing circumstances would help protect them.

Upon taking office, Schram refused to be ignorant and oblivion to the prevailing circumstances and started to inquire about the affairs of the students, staff, the university administration and its council. He extended his inquiries to students and invited them to express themselves. He also questioned why certain professors were using the University facilities to make money, one of which involved a lecturer of Indian origin of electronics studies who later become arch rival to Prof Schram and fabricated malicious facts about Prof Schram.

The more Prof Schram sniffed around for information, the more worried the Stagg Council became. As a matter of fact, Schram initiated audits into Unitechs financial expenditures and further referred a number of persons for criminal prosecution. Some of those cases led to the arrest of certain people but the police did not do a proper job, result in cases being struck out. The Stagg Council had to come up with a ploy to either stop or where possible, remove Schram. They sought the advice of the antagonist Indian Professor of Electronics who devised a smear campaign starting with the despising of Prof Schram’s education qualifications. The Stagg team was threatened with legal action hence were forced to make a public apology which they did. At that point, the Stagg Council realised that the Indian Professor would lead them to trouble hence abandoned him in the strategy. They resorted to a new plan.

The new plan of Stagg Council was to invoke their powers under the Unitech Act to revoke the appointment of Prof Schram for reasons only known to them. The plan was flagged with Minister Arore who then became the link to his deputy party leader Southern of The Party and Minister for Labour & Industrial Relations, Mark Mapakai, to revoke Prof Schram’s work permit. The revocation of the work permit dictated the type of visa Prof Schram needed to be Vice Chancellor of Unitech hence could not enter PNG without it. To his surprise, in early 2013 Prof Schram was refused entry when he tried to return to PNG after holidays in Australia.

Whilst that was going on, tensions at Unitech increased. Students went on strike and petitioned the Government. The 2013 Academic year was on the brink of being disrupted completely if the Government did not intervene. Prime Minister Peter O’Neill visited the school at the height of the tension. As usual, he soothed them with his sweet words. The Prime Minister quickly instituted a new interim University Council to be headed by Sir Nagora Bogan and an investigation team headed by retired Judge Mark Sevua. The Bogan team, in consultation with the PM appointed Prof Joseph Puma to be the acting VC. Everybody was asked to respect the investigation and provide information to the team to which most of them did, including Prof Schram in his exile.

Whilst the institution of the investigation saw Prof Schram kept at bay (in exile), a new team comprised of Papua New Guineans who were privy to some of the information of the former Council and Administration was now installed to govern the Unitech. That caused more worry and anxiety for the Stagg/Saulep team as they got so much at stake. Therefore the Stagg/Saulep team took legal action against the Government and the new Governing council. There was an interim stay order granted initially but that order was subsequently discharged hence there is no Court Order preventing the decision of the current interim Bogan Council and Puma administration.

The Sevua investigation was concluded and presented to the PM at the end of October 2013. The PM upon receiving the report said that the Government will “look into it” and take appropriate actions as recommended.

At the end of December 2013 and January 2014, the University Council of Sir Bogan advertised in the local newspapers of their decision to reinstate Prof Schram to the position of VC. The media advertisement clearly carried contents that stated that the Sevua report found nothing against Prof Schram hence the University Council had to reinstate him. Prof Schram had a legally valid contract hence the Council was compelled to reinstate him. The Sir Bogan Council pleaded with the Government to allow him to return.

As the 2014 academic year commenced, the students and the university is again being haunted by the same issue. To many who suspected Arore was the trouble maker, it was a sigh of relief when he was removed as Minister for Higher Education and replaced with Delilah Gore.

However, Delilah Gore’s first reaction caught many by surprise when she travelled to Lae to address the students only to have had selective meetings without addressing the students. It was understandable as she was a woman and could not have felt comfortable to address a rowdy student crowd. However, her recent statement has not only taken many aback, but opens the shell that covers the real motives and personalities behind the troubles of Unitech. So many inconsistencies, so many buck passing, lame and shallow excuses.

She mentioned there was an ongoing court proceeding. So what? Is that court active? Is there a stay order in place? The stay order we know was discharged. Who do you fool?

She mentioned about two University Councils. Hallo? Does the old Stagg council still in office even after her own government revoked and replaced with a new Sir Bogan Council? Is she implying that she doesn’t believe and respect the decision of her own Government? Totally illogical and lame!

Needles to point here that it was the Stagg Council that appointed Schram but for their own convenience instead inconvenienced them.

She said it is the responsibility of the University Council to appoint the VC. Off course it is. The Competent Council appointed and reinstated Prof Schram. What utter nonsense is that?

The PM just said “we’re still looking into the Sevua report” and he is still looking into it since October 2013. My goodness have you considered the plight of our students who’d commence the academic year early this year or busy striking deals with Oil companies? Whose interest weighs more on your in-tray scales –more kina for the potbellies or education of our future generation?

The independent report by Sevua was poised to be the basis of the decision on the ongoing Unitech Saga. Almost 6 months had lapsed and the Government is still looking into it? By contrast, it took the PM almost two weeks to come up with a solution for the Assylum Seekers deal with Australia and a little ounce of time to cook up a multi-billion dollar deal yet it is taking 6 months to decide on the institution that affects the education of our people?

Looks like more excuses than solutions! THE GOVERNMENT IS FAINTLY COMING UP WITH EXCUSES WHY PROF SCHRAM CANNOT RETURN BUT THE GOVERNMENT IS NOT TELLING US HOW TO BRING HIM BACK.

It baffles me when Tjoko Jandra was given citizenship within few days of being a resident of PNG by the same Immigration Department to look after a few potbellies whereas Prof Schram is continuously refused entry to attend to thousands for their education, not to mention the future of our country.

What Gore fails to realise is that her reasons are too shallow to force the students back to class. What is the point of the tail going to class when the head is in total disarray attributed to the Government’s action/inactions?

Whilst the Stagg/Saulep team may still be playing some part in this saga to protect their own interest, it is now becoming clearer that there is no other interest that the PM would have in Unitech than to have his fellow Southern Highlander keeping the position of VC. The ultimate buck stops with the PM. If he has not caused the problem at Unitech in the first place, then he is in a position to fix it. His passive connivance is inexcusable and deafening except to entrench an interest.

Prof Puma may have risen to the post of Acting VC by circumstance. However, he is now well connected to his own Southern Highlander at the helm of this country. He has tasted power, perks and privileges associated with the post. Who would, in his right frame of mind, sigh away from such an opportunity? Has he not taken over the fight from Stagg Council? Is it not safe to suggest that this is now PM fighting Puma’s fight? Delilah Gore is clumsily dancing to O’Neill’s music. Is it rather strange that PM would see his men in high ranking government positions?

Unitech is not fighting about Prof Schram. Schram is not the savour. Schram will be here today and gone tomorrow. The students are however fighting for justice. That justice must not be shelved, tempered, delayed and done, but must be seen to be done.

Good versus Evil. David versus Goliath. Unitech Becomes A Biblical Style Battle Ground For Justice.

Who would have thought unitech would become such a national symbol of the struggle between good and evil?   Our parliamentary Speaker Theo Zurenuoc  fights evil the cargo cult way, believing that destroying imagined symbols of evil will straighten up PNG.  Fortunately, those fighting evil at unitech seem more sensible, understanding that it is people not carvings that allow evil to prevail.  Japan is full up of unchristian worship places, idols etc, yet they have become a peaceful, just and civilised society that we can only dream of in PNG. The Japanese know that the most effective way to get rid of evil is for everyone to actively fight evil people.

Who promotes evil in the context of unitech?  Obviously it includes anyone who blocks truth and justice.  These noble values form the basis of civilised society and promoted in our constitution.    The core issue around unitech has been whether evil people will get away unpunished with unitech stealing and mismanagement, then running an innocent person out of PNG.   There is no clearer picture of good versus evil than in this example of injustice.   Seeing it should make the blood of all good people boil and explains why unitech issue centres around VC Dr Shram.

In any war between good and evil, we have 3 armies:

1.  Forces of Evil
The "evil" side includes all who stole or misused unitech money.   The Sengi report convincingly indicts former VC Misty Baloiloi as leader of the pack, with other staff involved, including former project manager Brian Kakini. Also joining evil are members of the former unitech council including Philip Stagg and Ralph Saulep who used council positions to gain unethical personal profit. Anyone who participated in deportation without proven cause of current VC Albert Schram is evil.  That includes former HERST minister David Arore and his friend "professor" Narayan Gehlot and must include some inside Foreign Affairs.   Recent news that Prime Minister Peter O'Neill secretly promised acting VC Professor Pumwa the job now held by Dr Schram may mean that the Prime Minister is on the evil side and possibly joined by the acting VC.

2.  Forces of Good
On the "good" side of the unitech war includes anyone who has spoken up strongly or taken action on behalf of Dr Schram.  This includes all unitech council members at the December 2013 meeting who voted for Dr Schram to be allowed to come back and serve his time in PNG as VC.  It includes all the outspoken speakers and writers telling us about whats going on at unitech.   It includes Mr Ken Polin of Unitech who apparently remains under threat of sacking because he spoke his mind in favour of Dr Schram.   It includes all students who are now doing whatever is necessary to pressure  government to stop being evil obstructionists.  No one can say unitech students should not have taken action.  Such nonsupporters forget that before students stood up, Dr Schram would have died of old age before anything was resolved. Progress was at snails pace or worse. Members of the forces of good will always praise nonviolent student actions because similar actions around the world by students or other small groups have defeated evil time and time again.   It is often a battle of unequal armies, between David and Goliath.  Evil has been defeated through independence movements, uprisings against dictatorships, and human rights struggles such as movements for racial civil rights and against aparthide.   Student uprisings are good if they stay nonviolent yet intensify until they defeat evil.

3.  Protectors of Evil
"Protectors of evil" rarely consider the implications when they silently do their jobs and stay out of trouble.  They are the people who become most surprised and upset when they find out which of the 3
categories they are tossed into.  Before they protest too much let them consider a famous quote repeated some time back in a PNGBlogs article:  Evil only takes over when good people do nothing.   This means that it is not enough to stay out of trouble and follow the rules.   Whenever we see injustice, we must fight against it, becoming soldiers in the forces of good.  Anyone who sees evil but looks the other way or stays quite become protectors of evil automatically. Many good people involved with the unitech issue have become protectors of evil.  They should be condemned, although not so harshly as we would condemn soldiers of evil.

Protectors of evil created the stalemate that has gone on for more than a year.   Unitech's acting VC Professor Pumwa might say he has done much to help Schram but growing evidence suggests otherwise. However, bending over backwards in fairness to him, he and his staff admit that they did nothing over the bare minimum job requirement to secure Schram's release from exile.  That makes them protectors of evil. Members of the former unitech council who stopped coming to meetings chaired by chancellor Stagg are in this category too.

Over the last year internet sites filled with articles identifying anyone who spoke against Schram and contributed to injustice.  The accused now includes unitech acting leadership whose conspicuous
silence makes them protectors of evil at best.  If there was any misinformation or distortions contained in internet articles, it was the civic duty of those who knew the truth to speak out and share it. The internet is the fairest communication outlet in history because it is so easy for those wrongly accused to defend themselves.   Anyone who ignores the growing power of social media in bringing out the truth does so at their peril, one example being past minister David Arore.  In this context it is very curious that neither government nor unitech officials ever spoke out against allegations made against them about unitech. Their silence either means they are either protectors of evil at best or soldiers of evil.   Soldiers of good will always defend themselves with evidence for the truth.  Last week on PNGBlogs we saw MP Gary Juffa refusing to respond to allegations made against
him.  This kind of defence makes him a protector of evil or worse.

Any actions the unitech administration took in recent weeks to discourage or suppress free speech and opinion must be condemned. Their actions cross the line from being protectors of evil to actually
joining evil.   It matters not what the unitech rules state when the rules promote  injustice.  Martin Luther King inspires us with this observation that when laws achieve unjust outcomes it is unjust to
enforce them.   Dutiful administrators who follow and apply rules without considering whether their applications promote justice or injustice are protectors of evil.   In thought, these administrators
are no different than soldiers guarding concentration camps of Nazi Germany and doing their job as they politely led prisoners to the gas chamber. The punishment against Mr Ken Polin's right to express his opinion put Unitech lawyer Simon Senge and possibly other unitech administrators squarely in the centre of shame because they are obviously following unitech regulations that achieves injustice by suppressing a basic human right.

Bending over backwards in fairness to Mr Senge, some suspect that he realised the evilness of his actions against Mr Polin and made amends by becoming the leaker of the "Sengi report".   If so we should praise him for that.   Leaking that report was an action by the forces of good.

OHE officials, especially Director General David Kavanamur, may fit the same shoe as unitech management.    It may be wrong to consider these people evil but they are definitely being protectors of evil.

Our aspiring nation will never shake ourselves of the forces of evil so long as there are so many protectors of evil around.   They must force themselves out of this destructive neutral ground and become true soldiers for the forces of good.   Our speaker Theo Zurenuoc will get the results he wants if only we have fewer protectors of evil and more soldiers of good.  The activism that developed around the unitech issue must grow and spread throughout PNG.
